Terms & Conditions

Effective October 11, 2026 · Last updated October 11, 2026

1. Your agreement with Monxvi

These terms govern MONXVI, the event photo and video capture, overlay, effects, and sharing platform provided by Monxvi, based in Ohio, United States ("Monxvi," "we," "us"). Your agreement for use of the service is with Monxvi. By creating an account or continuing to use the service, you agree to these terms. If you do not agree, do not use the service.

You must be at least 18 years old and able to enter a binding agreement. If acting for an organization, you confirm that you have authority to bind it.

2. Accounts and the service

Provide accurate account and business information, keep it updated, protect your sign-in credentials, and notify us of suspected unauthorized access. You are responsible for activity under your account. We grant you a limited, non-exclusive, non-transferable right to use the service for your events within your selected plan.

Available features and storage limits are described in the app and at checkout. Features labeled demo, prototype, or coming soon are not promises of production availability. Download important clips before your plan’s storage period ends. We may update the service and do not guarantee uninterrupted, error-free performance or compatibility with every device.

3. Payments, subscriptions, and refunds

Paid plans are monthly subscriptions that renew until canceled, as disclosed at checkout. Review the checkout for the price, currency, taxes, renewal frequency, and applicable terms before purchasing. Manage cancellation through the billing portal or Paddle; cancellation stops future renewals according to the applicable billing terms.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Payment, billing, tax, cancellation, and refund mechanics are governed by Paddle’s Buyer Terms. Our Refund Policy offers a 30-day refund request period. Mandatory consumer rights remain unaffected.

4. Acceptable use

You must not use the service to:

  • Break the law, commit fraud, send spam, harass others, or infringe privacy, publicity, or intellectual property rights.
  • Create or distribute unlawful, hateful, exploitative, or non-consensual content, including sexual exploitation of minors or deceptive deepfakes.
  • Upload malware, probe or interfere with security, scrape the service without permission, bypass technical limits, or attempt to jailbreak AI safeguards.
  • Reverse engineer the service except where law permits, or resell or redistribute the software without our permission.

5. Event recordings and content rights

You retain your rights in the recordings, photos, logos, music, prompts, and other content you supply. You must have the necessary permissions and licenses, including consent from guests where required and appropriate permission for recording children. You are responsible for event notices, sharing choices, and lawful collection and use of guest information.

You grant Monxvi a limited license to host, process, reproduce, and transmit your content only as needed to provide, secure, and support the service. Monxvi retains ownership of the platform’s software, documentation, branding, and other intellectual property; using a template does not transfer ownership of its underlying design.

As between you and Monxvi, you retain any rights you hold in edited recordings and AI outputs, subject to third-party rights and applicable law. Outputs may not be unique or eligible for copyright protection; no exclusive rights are guaranteed.

Rights holders can report suspected infringement to monxvi.app@gmail.com with their contact details, identification of the protected work, the location of the disputed content, and an explanation of their claim. We may restrict or remove disputed content and suspend or terminate repeat infringers.

6. AI-assisted features

AI may recommend settings or generate content. You are responsible for your prompts, having rights to inputs, checking outputs for accuracy and appropriateness, and how you use them. Do not submit sensitive personal information unnecessarily. AI outputs may be inaccurate, biased, or unsuitable and are not a substitute for regulated professional advice without qualified oversight.

We may refuse or filter AI requests, remove or restrict content, and suspend accounts to address prohibited use, safety risks, or infringement. AI suggestions do not guarantee that every suggested effect is available or will be applied to a recording.

7. Suspension and termination

We may suspend or terminate access for material breach, non-payment, security or fraud risks, or serious or repeated policy violations. Where reasonable, we will notify you and offer an opportunity to resolve the issue; immediate action may be necessary for safety or legal compliance. You may stop using the service at any time and request account deletion at monxvi.app@gmail.com; cancel your subscription separately to stop renewals.

Access may end when your account is terminated. Export content while you still have access; we do not guarantee a post-termination export window. We handle remaining data as described in our Privacy Notice.

8. Warranties and responsibility

To the fullest extent permitted by law, the service is provided "as is" and "as available," without implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Keep independent copies of important event media.

To the extent permitted by law, Monxvi is not liable for indirect, incidental, special, or consequential damages, including lost profits or lost data. Our aggregate liability relating to the service is limited to the fees you paid for it in the 12 months preceding the claim. These limits do not exclude liability that cannot lawfully be limited, including fraud, willful misconduct, or death or personal injury where applicable, and do not reduce mandatory consumer rights.

9. Changes, governing law, and contact

We may revise these terms and will update the date above. We will provide notice of material changes through the service or your account email before they take effect where required. Continued use after the effective date constitutes acceptance.

Ohio law governs these terms, excluding conflict-of-law rules. Subject to mandatory consumer protections and rights to bring proceedings elsewhere, disputes may be brought before courts with jurisdiction in Ohio. For questions or complaints, contact Monxvi at monxvi.app@gmail.com.
